These Ecommerce Plug-In Product Terms and Conditions shall apply to the extent a Counterparty is enabling or reselling a FreedomPay Ecommerce Plug In. For purposes of these terms and conditions, “Counterparty” shall mean a Client, Reseller, or Customer of a Reseller, as such terms are defined in an applicable agreement: 

1. In order to enable a FreedomPay Ecommerce Plug In, Counterparty must have in effect a Secure Switching Product Agreement, Reseller Agreement, or other governing agreement for purchase of products and/or services, including the relevant Ecommerce Plug In, from FreedomPay or an authorized Reseller of FreedomPay. 

2. If Counterparty is interested in signing a governing agreement directly with FreedomPay, or is unsure if it has such an agreement in place, it may contact FreedomPay at fpsales@freedompay.com   

3. FreedomPay is not responsible for the operation of any third-party services and FreedomPay makes no representations or warranties, express or implied, as to any third-party services that FreedomPay uses, enables or provides, including but not limited to fraud protection, 3-D Secure, DCC, loyalty or discount programs and/or any other ancillary services enabled or provided by FreedomPay now or in the future.
